Fluorosilicon Association Urgently Calls the Refrigerator Industry to Actively Meet the US "337" Investigation

In November of last year, two refrigerant manufacturers under China National Chemical Corporation (ChemChina) found themselves at the center of a significant legal challenge when Ingres Chemical Co., Ltd. from the United States and a UK-based company filed a "337 investigation" with the U.S. International Trade Commission (ITC). This move sparked widespread concern within the industry, as the outcome could have far-reaching implications for Chinese refrigerant producers. The ITC has now completed its preliminary investigation, and a final decision is expected by late March. The applicants are seeking a general exclusion order, which would not only prevent ChemChina’s products from entering the U.S. market but could also block other Chinese companies producing similar refrigerants. In early March, the China Fluorosilicon Association took action, stepping in to coordinate efforts among industry players. On December 21, 2007, the ITC launched a 337 investigation into R-134a refrigerants following a complaint from British company Ingredifluor Chemical Co., Ltd. and Ineos Fluorochemicals of Los Angeles. The investigation covers several types of refrigerants, including 1,1,1,2-tetrafluoroethane, R-134a, HFA-134a, HFC-134a, and others. Two Chinese companies—China Chemical Industry Modern Environmental Protection Chemicals (Xi’an) Co., Ltd. and Ningbo (Group) Co., Ltd.—were listed as respondents. The complainants are requesting both a general exclusion order and a temporary stop-sale order. Although the lawsuit was initially targeted at specific companies, it has broader implications for the entire Chinese refrigerant industry. According to Mei Shengfang, Secretary-General of the China Fluorosilicon Association, the U.S. remains one of the key markets for Chinese refrigerant exports. Whether ChemChina wins or loses this case will significantly impact the future of the domestic refrigerant sector. To address the situation, the association organized the first major meeting of leading refrigerant manufacturers in China. During the discussions, participants reached a unified stance, emphasizing that the case affects the whole industry, not just individual companies. They also decided to hire legal experts to assist ChemChina in understanding the complex legal landscape and developing a coordinated response based on the investigation's progress. With strong financial backing and confidence in their legal position, Chinese companies are prepared to defend their interests. The collective effort underscores the importance of unity in facing international trade challenges.
